Beta Service Notice
FlyTabs is an early personal project run by an individual developer based in Alberta, Canada. It is provided as a free beta for evaluation purposes. By creating an account or using FlyTabs (the “Service”) you agree to this notice.
1. Nature of the Service
FlyTabs is a personal side project, not yet a commercial offering. There is no incorporated company behind it at this time. The Service is provided “as is” and “as available”, with no warranties, no uptime guarantees, no support obligations, and no commitment to data preservation. Features may change or be removed without notice. The Service may be discontinued at any time, with or without prior warning.
2. Eligibility and access
You must be at least 16 years old. Access to the Service is currently open, but the operator may restrict access or move to invite-only at any time, with or without notice. You agree to keep your username and password confidential, and you are responsible for all activity under your account.
3. Your content — ownership
You retain ownership of the content you create in FlyTabs (“Your Content”). Nothing in this notice transfers ownership of Your Content to the operator.
4. License you grant for stored content
To run the Service, you grant the operator of FlyTabs a non-exclusive, worldwide, royalty-free licence to host, store, transmit, display, reproduce, and create technical adaptations of Your Content solely to operate, secure, back up, and improve the Service (for example: rendering previews, generating PDFs, displaying Your Content back to you, and storing backups).
5. Public documents
FlyTabs lets you mark a document as Public, in which case it appears in the FlyTabs community library, is visible to other users and unauthenticated visitors, and can be duplicated by other users.
By making a document Public, you additionally grant:
- To FlyTabs: a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to host, display, reproduce, distribute, modify, and create derivative works of that document in connection with the Service, including in the community library and in promotional materials about the Service.
- To FlyTabs, additionally, the right to include Public documents in curated collections, templates, sample libraries, or other compiled or derivative works produced or distributed by FlyTabs (“FlyTabs Collections”), including FlyTabs Collections offered on a paid or subscription basis. When your Public document is included in a FlyTabs Collection, we will provide reasonable author attribution (such as your username) unless attribution is impractical given the format. We are not obligated to pay you for inclusion in a FlyTabs Collection, and inclusion does not transfer ownership of the underlying document.
- To other users of the Service: the right to view and to duplicate that document within the Service (the in-app “duplicate” feature).
You acknowledge that:
- Once a document has been made Public, the change cannot be reversed — public visibility is permanent and the document cannot be returned to private.
- Copies that other users have made of your Public document will continue to exist independently of the original.
- FlyTabs may retain copies for archival, operational, and legal purposes.
6. You are solely responsible for Your Content
You represent and warrant that:
- You own or have all necessary rights to Your Content;
- Your Content does not infringe any third party’s intellectual property, privacy, publicity, or other rights;
- Your Content does not violate any law applicable to you or to a place where the Service is accessed.
Until FlyTabs receives a valid report and has a reasonable opportunity to act, legal responsibility for unlawful, infringing, or otherwise improper content rests with the user who uploaded or published it. The operator may, but is not obligated to, monitor user content, and may remove or restrict access to any content at any time, with or without notice, including (without limitation) where the operator believes content violates this notice or applicable law.
7. Acceptable use
You agree not to use the Service to:
- upload, create, or publish content that is unlawful, infringing, defamatory, hateful, harassing, sexually explicit involving minors, or that promotes violence or fraud;
- distribute malware, phishing, or other harmful code;
- attempt to gain unauthorized access to the Service or other accounts;
- scrape, crawl, or systematically extract data from the Service except as expressly permitted;
- resell, sublicense, rent, lease, or commercially redistribute documents obtained from the Service, including PDF exports, in whole or in substantial part;
- use the Service or content from the Service to train machine-learning models without the operator’s written consent;
- use the Service in any way that violates applicable law.
Personal, internal, and non-commercial use of documents you author, and of public documents you duplicate within the Service, is permitted.
8. Reporting unlawful or infringing content
If you believe content on FlyTabs infringes your rights or is otherwise unlawful, please contact [email protected] with:
- your name and contact details;
- identification of the work or right you say is infringed (and proof you hold it, where applicable);
- the URL or other reasonable means to locate the content;
- a statement made in good faith that the use you complain of is unauthorized or unlawful; and
- your signature (physical or electronic).
The operator reviews reports promptly. For complaints under Canadian copyright law, FlyTabs will forward valid notices to the user responsible for the content, in line with the Canadian notice-and-notice regime. The operator may also remove or disable access to reported content at its discretion. Repeat infringers will have their accounts terminated.
9. Data, backups, and termination
You are responsible for keeping your own backups of anything important. While reasonable efforts are made to preserve data, no guarantee is made against loss. The Service may be paused, reset, or shut down with little or no notice. Your account may be suspended or terminated at any time, with or without notice, including for any suspected violation of this notice.
10. No liability
To the maximum extent permitted by Alberta law, the operator of FlyTabs accepts no liability for any loss, damage, cost, or expense — direct, indirect, incidental, consequential, or otherwise — arising out of your use of the Service, including but not limited to lost data, lost profits, downtime, loss of goodwill, or third-party claims relating to your content. Nothing in this notice excludes liability that cannot be excluded under applicable law (for example, liability for gross negligence, wilful misconduct, or death or personal injury caused by negligence).
11. You indemnify the operator
You agree to defend, indemnify, and hold harmless the operator of FlyTabs from any third-party claim, demand, or expense (including reasonable legal fees) arising from (a) Your Content, (b) your use of the Service, or (c) your breach of this notice or of applicable law.
12. Privacy
The personal data we collect (such as your email, username, account activity, and any content you upload) is used solely to operate, secure, and improve the Service. A detailed Privacy Notice will be published as the project develops; in the meantime, direct any privacy questions or requests to [email protected].
13. Changes
This notice may change as the project evolves. Material changes will be communicated to registered users (for example by email or in-app notice) before they take effect. Continued use after the effective date constitutes acceptance. A future commercial release of FlyTabs will be subject to separate Terms of Service replacing this notice.
14. Governing law
This notice is governed by the laws of Alberta and the laws of Canada applicable in Alberta. Any disputes will be resolved in the courts of Calgary, except where mandatory consumer-protection laws in your country of residence give you the right to bring claims in your local courts.
